The shortage of skilled workers in the IT sector is now so blatant that special options have been created in German immigration law to make it easier for foreign IT specialists to enter the country. Where professional recognition is usually required for a skilled worker’s permanent residence, there is the option for IT professions for the employer to assess their professional suitability for the job themselves. This means that people who have not completed training or studies in the relevant reference occupation according to German standards can also start working in Germany, but also those who have been able to build up their skills through many years of project and professional experience. The three-year dual training courses in IT professions, as well as professions after completing a bachelor’s or master’s degree in IT, are non-regulated professions. There is no legal requirement for them to practice their profession. Therefore, no state body is required for the process of recognizing the foreign professional qualification; this is usually carried out by the IHK FOSA.
Professional recognition of IT professions is possible, but not required in terms of residence or professional law. Anyone who wants to go the route of professional recognition must be prepared for a lengthy process, at the end of which there will probably be a considerable deficit in practical and theoretical content, which will have to be compensated for by the employer as part of an adjustment measure.
Signite therefore recommends that this professional group take advantage of the facilitations for IT professions created in the Skilled Immigration Act and rely on the possibility of the employer assessing the skills of the skilled worker when entering and taking up work in Germany.
